In order for their claim to be valid, an NIE (Notice of intent to enforce) would have to have been filed by the end of 1998. There is also the issue of the publication of a derivative work (the 2-piano reduction) in 1922. Under the most commonly applied doctrine of "publication", the first publication of any version of a work incorporates all extant versions of that work. The first publication of the score (which existed from 1916 onward), thus took place in 1922, not 1923.
